Bryan Carney practices in the field of Health Care Litigation with specific focus on the defense of long-term health care providers, including skilled nursing facilities, acute care facilities, assisted living facilities and the health care practitioners and corporations which own, operate and manage these facilities.

Bryan defends health care providers from claims including fraud, unfair business practices, battery, wrongful death, statutory violations and professional negligence. A large portion of Bryan’s practice is devoted to extracting health care providers from claims made under California’s “Elder Abuse Act”.

Over the last decade, California’s Elder Abuse Act has made an enormous impact on the financial viability of health care facilities. In 2004, two of Bryan’s cases resulted in published Court of Appeal opinions which define the parameters of the Elder Abuse Act and how this legislation affects health care providers. (Country Villa v. Superior Court, (2004) 120 Cal. App. 4th 426; Benun v. Superior Court, (2004) 123 Cal. App. 4th 113).

Prior to joining Fonda Fraser, LLP, Bryan was a Senior Litigation Associate at the law firm Morris, Polich & Purdy, LLP.
