Summary: Very long and difficult trial defending allegations of a delayed C-section in the face of fetal distress resulting in permanent and devastating neurological injury to the newborn. This 37-week gestation was monitored by the on-call OB from home via computer up-load of fetal monitor strips. The OB presented to the patient's bedside some 4 hours after identifying the strips as concerning and C-section was ordered only to be delayed by immediate availability of anesthesiologist and by on-call OB's desire to wait for primary OB to arrive at hospital to begin surgical delivery. Apgars were 1, 2 & 4 at one, five and 10 minutes. Neonatology diagnosed hypoxic ischemic encephalopathy. While all these cases are hard to defend, this one was further complicated by the celebrity of the newborn’s grandfather.
